Indefinite Leave to Remain (also referred to as Settlement Visa and Permanent Residence visa) allows the holder to live and work in the UK without any time or employer conditions or restrictions.
To be eligible for this visa, there are different qualifying periods, dependent on which immigration route you have followed.
- If you have had a Tier 2 visa and been employed legally by a Tier 2 Sponsor ( one or more) for 5 years, then you should be eligible.
- If you have a Tier 1 Entrepreneur visa, you will also be eligible after 5 years but you can accelerate this period to 3 years, if you have met certain criteria on job creation within your business.
- If you have a Tier 1 Investor visa, the 5 year rule applies again and there are accelerated qualifying periods of 3 and 2 years, dependent on the revenue generated by the business you have invested in.
- There is also a long residency option of 10 years of lawful residence in the UK, which could be via more than one of the options listed above as well as other immigration routes.
All applicants must be able to show they have the required level of English language ability and have passed the Life in the UK test. Note there are a few age related exceptions to this rule.
